Music has been written and recorded for centuries, and there are only so many combinations of notes and chord patterns that exist – some are bound to sound similar. There is a threshold of similarity that warrants a legal copyright infringement, and Russian producer Arty thinks Marshmello‘s Happier sounds too similar for it to be a coincidence.
The Tenneseean magazine writes, “Because the copyright lawsuit, filed in federal court in California, focuses only on the remixed elements of the song, the case is sure to grab attention in the music industry. Arty is represented by prominent Nashville copyright attorney Richard Busch, who has won a number of landmark cases, notably Marvin Gaye’s lawsuit against Pharrell Williams and Robin Thicke over the song ‘Blurred Lines.’”
Our friends at YourEDM made a side-by-side of the two melodies for us to observe. Arty’s is in green, Mello’s in red
Below are the tracks named in the suit. Do you think they sound similar enough to warrant a copyright infringement? Let us know in the comments.
